1. The Promoter of this prize draw is CAVU Experiences (AMER) LLC with its office located at 100 N LaSalle Street, Chicago, IL 60602, United States. 

Prize

2. By entering this prize draw, you are in with a chance of winning one (1) travel voucher worth approximately US$250 (“Prize”).

3. The Prize is not negotiable or transferable and no cash alternative will be offered.

How to enter

4. No purchase is necessary to enter or win.

5. This prize draw will run from April 24, 2024 at 12:01am MST (“Opening Date”) until September 30, 2024 at 11:59pm MST (“Closing Date”) inclusive.

6. All prize draw entries must be received by the Promoter by no later than the Closing Date. All prize draw entries received after the Closing Date will automatically be disqualified.

7. To enter the prize draw you must fully complete and successfully submit the survey via the QR code(s) located throughout the Escape Lounge at Phoenix Sky Harbor International Airport – Terminal 3. One (1) entry permitted per person who submits the survey.

8. The Promoter will not accept responsibility for prize draw entries that are lost, mislaid, damaged or delayed in transit, regardless of the cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, network, server, computer hardware or software failure of any kind.

9. The Promoter will not accept proof of postage or transmission as proof of receipt of entry to the prize draw.

10. By submitting a prize draw entry, you are agreeing to be bound by these terms and conditions.

Eligibility

12. To enter this prize draw you must be a resident of the US, aged 18 years or over.

13. This prize draw is not open to any employees of the Promoter or any of their affiliate companies, their families, agents or anyone else connected with this prize draw.

14. By entering this prize draw, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you provide proof that you are eligible to enter the prize draw.

15. Prize draw entries cannot be returned.

Announcing the winner

16. One (1) winner will be selected in a random draw from all valid entries received. The draw will take place no later than 14 days after the Closing Date and the winner will be announced on 14th October 2024 (“Announcement Date”).

17. The Promoter’s decision is final and no correspondence or discussion will be entered into.

18. The Promoter will contact the winner personally as soon as practicable after the Announcement Date by sending a direct message to the Instagram account used to enter the competition.

19. The name of the winner will be provided on request.

Claiming the prize

20. Please allow 30 days for delivery of the Prize.

21. The Prize may not be claimed by a third party on your behalf and the Promoter may require proof of identity upon request.

22. The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available or has not claimed their prize within 14 of days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the eligible entries received before the Closing Date.

23. The Promoter does not accept any responsibility if you are not able to take up the Prize.

Data protection

24. If you are the winner of the prize draw, you agree that the Promoter may use your name, image and town or county of residence to announce the winner of this prize draw and for any other reasonable and related promotional purposes.

25. You further agree to participate in any reasonable publicity required by the Promoter and agree to the Promoter’s privacy policy which can be found at https://escapelounges.com/us/support/privacy-policy/

General

26. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the prize draw.

27. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize draw where it becomes necessary to do so.

28. All income taxes resulting from acceptance of prize are the responsibility of winner. By entering this prize draw, you accept and agree to these terms and conditions and the decisions of the Promoter, which shall be final in all matters. By entering this prize draw, you waive all right to, and hold harmless the Promoter and any third party platform (which in no way sponsors, endorses, sponsors or associates with this prize draw) on which this prize draw is advertised from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys' fees) arising out of or in connection with participation in this sweepstakes or the acceptance, use, or misuse of any prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All federal and state laws apply.

You agree that all matters arising out of or relating to this prize draw and these terms and conditions are governed by, and construed in accordance with, the laws of Delaware, without giving effect to any of its conflict of laws provisions thereof. You further agree that any legal suit, action, or proceeding arising out of or relating to this prize draw and these terms and conditions shall be brought exclusively in the applicable federal or state courts located in Wilmington, Delaware.
